The legal background of the Article 7(3) EUTMR, consists in two types of possible claims (principal or a subsidiary). A claim under Article 7(3) EUTMR cannot be raised for the first time at the appeal stage. The right way to file a claim is when filling the application, after filling it and not later than in the reply to the first objection letter.
