Can letters, numerals and acronyms be a sign of distinctiveness? The speaker analyses the current legislation. Before January 2014: single letter marks represented in a standard character were objected to on the basis of non-distinctiveness. But after January 2014: following C-265/09P, Alpha case-by-case assessment, the conclusion is they are not devoid of distinctive character per se. The speaker considers that expressions such as ‘4U’ will be perceived, at least by the English-speaking consumer, as an abbreviation of the phrase ‘for you’.
