Draft Guidelines of the 2022 edition


The EUIPO’s policy on IP matters is reflected in the Guidelines on trade mark practice and the Guidelines on designs practice, which are regularly revised by the Office in a cyclical and open process.

The draft Guidelines of the 2022 edition are now available online for your review and suggestions.

The sections containing the proposed changes that are in scope for this year’s revision are indicated with a green tick in the index below.

The original text of the draft Guidelines is in English. Revised translations of the various sections into the four other working languages of the Office will be added shortly, as they become available.

The text can be accessed as a clean version or as a version with tracked changes, which enables you to compare it to the texts currently in force.

This year, comments and suggestions must be submitted via the new electronic tool, Review Space. You have received your credentials in a separate email together with a Review Space tutorial.

Review space has two means for providing feedback.

  • Adding ‘Comments’, which should only relate to the proposed changes that are marked in the Guidelines. These comments will be considered by the Knowledge Circles in the current cycle, that is, for the version of the Guidelines that will be published in 2022.
     
  • Adding ‘Suggestions’, which do not relate to the changes that are marked in the Guidelines, but which can cover other general or specific matters. These suggestions will be considered by the Knowledge Circles for subsequent versions of the Guidelines.

The Office welcomes your comments by Friday 01/10/2021.

All submissions received will be published on the EUIPO Website at the end of the consultation exercise. In case you do not wish your submission to be published, please send your comments to GuidelinesFeedback@euipo.europa.eu clearly indicating them as confidential.

Following the consultation process, the updated Guidelines will be submitted to the Members of the EUIPO Management Board for consultation before their adoption by the Executive Director.

Once adopted, the Guidelines will enter into force during the first half of 2022. They will then be translated into the other official EU languages.
