The European Observatory on Infringements of Intellectual Property Rights is a network of experts and specialist stakeholders.

History
The Observatory was created as part of the Commission's Internal Market and Services Directorate-General in April 2009 under the name of the European Observatory on Counterfeiting and Piracy. EUIPO, as the EU's principal agency devoted exclusively to IP matters, began co-operating closely with the Observatory under a Memorandum of Understanding signed in April 2011.
Following a proposal by the Commission, backed by the European Parliament and the Council, the Observatory was fully entrusted to EUIPO, formerly known as OHIM, on 5 June 2012.
The Regulation transferring the Observatory to EUIPO renamed it as the European Observatory on Infringements of Intellectual Property Rights. Under this Regulation EUIPO has to finance the Observatory's activities. The Observatory will draw on EUIPO's expertise, experience and resources with a view to becoming an information centre par excellence.
The Observatory is managed by EUIPO and is organised as follows:
- Operations & Projects Area, managed by a Deputy Director, which includes two services
- IP in the Digital World and Awareness Service
- Enforcement and SMEs Service
- Economics & Statistics Service, managed by the Chief Economist of the Office
Discover our network
The Observatory network is composed of public- and private-sector representatives, who collaborate in active working groups.
The core Observatory network is made up of public sector representatives, private sector representatives, civil society representatives and observers. The public sector representatives are designated by each Member State. Private-sector representatives include a broad and balanced range of Union and national bodies.
There are a number of other networks that are created when there is a specific need, such as a project to coordinate, or a particular activity to carry out.
There are also Expert Groups made up of experts proposed by the stakeholders or by EUIPO. These groups help guide in the implementation of projects in specialised fields of activity.
Although the Observatory has no direct enforcement powers, it brings together a wide range of stakeholders who use their technical skills, experience and knowledge to protect and promote IP rights and support those directly engaged in enforcement.
The Observatory stakeholders
Who are they?
The stakeholders include representatives from both the public and the private sector. Members of the European Parliament and institutional partners are also vital participants, whose involvement allows the European Parliament, the European Commission Services and Member States to follow and give advice on the Observatory's work.
Private-sector representatives include a broad and balanced range of Union and national bodies representing the various economic sectors, including creative industries, most involved or experienced in the fight against infringements of intellectual property rights. Consumer organisations, small- and medium-sized enterprises, authors and other creators are also represented.
For building up the contingent of private-sector stakeholders, the Observatory has used a published set of criteria designed to ensure that the Observatory can benefit from a broad range of expertise, whilst ensuring that meetings remain manageable and functional.

Criteria for new stakeholders
- Pan-European associations or international organisations
- Registered in the EU Transparency Register
- Not individual corporations
- Affected by counterfeiting or piracy and/or active in enforcement
- Able to represent civil society/consumers or companies/authors/creators within their specific sectors
- Able to provide key information about a particular sector, including statistical data in compliance with Article 5(2)(b) of Regulation (EU) No 386/2012
How to apply to become a stakeholder of the Observatory
Submit a written request to the attention of the Director of the Observatory, Paul Maier, stating that the association/organisation complies with the above criteria and proving that it is on the EU Transparency Register. The Observatory working groups
The working groups were set up on the basis of proposals by stakeholders and are used extensively by the Observatory for guiding the implementation of projects that are part of its work programme. Their fields of work range from legal matters, improved evidence building, consumer awareness and enforcement-related matters, to the growing number of issues surrounding IP in the digital world.

The Observatory Expert Groups
The Expert Groups help and guide the implementation of Observatory projects in focused and specialised areas, and are made up of experts proposed by the stakeholders or by EUIPO. Experts are called upon to provide expert support to Observatory’s agreed projects and activities. Experts represent themselves and not a particular organisation nor institution.
Insofar as possible, Expert Groups are balanced as regards geographical coverage and gender of the experts, as well as the sector they belong to or have experience in. Balance is also sought to cover both counterfeiting and piracy issues. A particular Expert Group will exist only as long as its work is still required; on the other hand, new Expert Groups can be created as needed.

Meetings
The Observatory works on a project-based approach that involves the collaboration of stakeholders at various levels.
Within this framework, meetings of the various working groups are crucial for ensuring that agreed projects and activities receive expert support and are managed appropriately. Working groups therefore meet regularly throughout the life of a project, as required.
At a higher level, larger public- and private-stakeholder meetings are convened. These adopt a more strategic approach to the overall work programme and provide a consultative platform for evaluating all existing and proposed objectives and work-streams. Public- and private-stakeholder meetings are usually held twice a year.
Finally, a joint Plenary meeting is held once a year to discuss and agree upon the Observatory's overarching strategy in the light of existing work and emerging requirements.

Plans and programmes
The Observatory Multiannual Plan Extension 2019-2020 served to extend the Multiannual Plan 2014-2018 until the end of the EUIPO Strategic Plan 2020 (June 2020). The strategic goals and key initiatives for the Observatory for the next five years are now fully embedded in the EUIPO Strategic Plan 2025
Work programmes
The Observatory produces yearly work programmes that outline the activities to be undertaken in the framework of the Multiannual Plan (until 2020) or EUIPO Strategic Plans.
Regulation (EU) No 386/2012 of the European Parliament and of the Council of 19 April 2012
This Regulation entrusted the European Union Intellectual Property Office (EUIPO) with tasks related to the enforcement of intellectual property rights, including the assembling of public- and private-sector representatives as a European Observatory on Infringements of Intellectual Property Rights.
