Notifications of detentions in the IP Enforcement Portal (IPEP)

01 marzo 2021

Recently, the Belgian customs started to notify the detentions of infringing goods through the Suspicious Case feature of the IP Enforcement Portal (IPEP) adding to the other authorities reporting already through the tool.

Recently, the Belgian customs started to notify the detentions of infringing goods through the Suspicious Case feature of the IP Enforcement Portal (IPEP) adding to the other authorities reporting already through the tool.
Already the customs authorities of Cyprus and Luxembourg Customs, the Spanish Guardia Civil and the Hungarian Customs Airport Directorate have started to use IPEP to notify the detentions to those rights holders who have accounts in the tool.

We invite our users/rights holders to make sure that their Contact Points for Belgium, Cyprus, Luxembourg, Hungary and Spain are updated in the tool and that they are aligned with the enforcement contacts provided in their AFA.

It is also important to inform those Contact Points and to give them access to IPEP, for them to be able to reply to the Suspicious Case (notification of detention). It is possible to give them access with no PIN SAFE, so the contact points cannot access the Product and AFA Information.

In any case, the Main enforcement contact of the company is always in copy of the e-mail notifying the creation of the Suspicious Case (notification of detention).

Please be also aware that there is a deadline to respond and that the customs authority receives an acknowledgement of receipt, once the Suspicious Case has been opened and viewed by the rights holder (respective contact point of the company).

In the documents area of the IP Enforcement Portal landing page, you will find a short tutorial on how to reply to a Suspicious Case (notification of detention).
