Notification of detentions by the Spanish Cuerpo Nacional de Policía (National Police Force)

The Spanish Cuerpo Nacional de Policía have started to notify detentions of infringing goods through the ‘Suspicious Case’ function of the IP Enforcement Portal (IPEP).

The IPEP team would like to inform rights holders using IPEP that the Spanish Cuerpo Nacional de Policía have started to notify detentions of infringing goods through the ‘Suspicious Case’ function of IPEP.

Rights holders are strongly advised to make sure their contact points for Spain are updated in IPEP and that they are aligned with the enforcement contacts provided in their AFA. Contact points need to have access to IPEP to be able to react to the notifications.

Replying to a suspicious case

In the documentation area of the IPEP landing page, you will find a short tutorial on how to reply to a detention notification (Suspicious Case).

Enforcers include a deadline for rights holders to respond. They also receive an acknowledgement of receipt once the Suspicious Case has been opened and viewed by the rights holder (or respective contact point of the company).

When an enforcement authority creates a suspicious case involving a company and products, the system will send a corresponding email, including a link to the case details, to a recipient (Contact Point) selected from IPEP. A copy of the email is automatically sent to the Main enforcement contact in the company for the enforcement authorities and to the company’s email. Please note that the deadline set by the enforcement authority to reply will also appear in the mail.
