Checklist

It's important to plan ahead because trade mark applications can be refused, in which case no refunds are given.

Most applications fail either because someone else got there first, or because the mark was not distinctive.

A trade mark is valid for 10 years and can be renewed indefinitely.

Try to position yourself in the future and think whether your trade mark will still be a correct representation of your brand after 10 years or more. Be aware that once you have filed your mark you cannot make alterations to it.

We would kindly like to remind you, that long lists of goods and/or services may lead to a number of disadvantages, namely:

  • a higher risk of classification deficiencies;
  • delays in publication and registration of the EUTM;
  • an increased risk of conflicts with other trade marks (oppositions);
  • an increased risk of a trade mark being eventually cancelled because of a similarity to an earlier mark or non-use of all the registered goods and/or services.
