Publication of Boards of Appeal case-law research reports


In May 2021, the Boards of Appeal (BoA) Consistency Circles project was launched. It was initially started as a pilot project to prepare the ground for the launch of the BoA Action Plan 2021-2026, designed to support the maintenance and development of a consistent decision-making practice.

The Consistency Circles analyses and discuss case-law in order to identify trends with a view to developing a common understanding on relevant legal issues, reflected in so-called case-law research reports. The aim is to enhance the predictability of decisions and to increase knowledge, awareness and transparency among the various BoA stakeholders.

The first of those reports, Trade marks contrary to public policy or accepted principles of morality and The distinctive character of slogans are now available on the EUIPO website, under Boards of Appeal.

These reports are working documents that reflect existing case-law, the results of discussions within the Consistency Circles and the General Consistency Meeting of the BoA at the given date of the report. They should not be considered as having any binding effect, on the BoA.
