1 Participation in this free IP personalised consultation is open on equal terms to all legal persons falling within the scope of the Treaties. This includes all SMEs registered in the EU. SMEs registered in Iceland, Norway and Liechtenstein enjoy full participation to the single market under the European Economic Area (EEA) Agreement and therefore have equal access to this initiative. For British applicants: since 1 February 2020, the UK is no longer a Member State of the EU. However, in accordance with Article 126 and Article 127(1) of the EU-UK Withdrawal Agreement, EU law continues to apply to and in the UK during a transition period which will end on 31 December 2020. This scheme extends thus to SMEs and representatives established in the UK during that transition period.

2 The IP Pro Bono services should not be confused with the Effective Dispute Resolution (EDR) service. The EUIPO is offering a special COVID-19 non-legal service to enable SMEs to take an informed decision on which dispute resolution mechanisms to select for settling any disputes before the EUIPO. This special non-legal service is called EDR and can be requested by an SME in the following EUIPO proceedings: opposition proceedings (after the cooling-off period) for unrepresented SMEs; cancellation proceedings; invalidity proceedings; appeal proceedings. The EDR is outside the scope of the present IP Pro Bono initiative. The function of the EDR service will be to inform SMEs about the following settlement mechanisms available either at the EUIPO or elsewhere: mediation, conciliation, assisted negotiation, early neutral evaluation, and (non-binding) expert determination. One of the possible outcomes of the EDR is that the SME is advised to revert to the pro bono service or to seek legal advice. The IP Pro Bono services can nevertheless include professional representation of SMEs in any of the abovementioned settlement mechanisms and can also include advising on possible settlement mechanisms during the cooling-off period (in opposition proceedings) and where the parties are represented.

With reference to pro bono services, the EUIPO is drawing up a list of service providers based on the applications received after the publication of a Call for expression of interest (CEI). The EUIPO has committed to collecting and classifying the providers, and to assisting the SME by providing the contact details of those that match the SME’s needs.

The list is not intended to be exhaustive and IP pro bono services may be sought outside the EUIPO initiative.

The services offered and provided by the IP pro bono providers are not EUIPO services. The accuracy of the information provided is the exclusive responsibility of the pro bono providers.

The EUIPO does not guarantee the availability, the service level nor the actual provision of the EDR or the IP Pro Bono services.

In the context of this free IP personalised consultation initiative, the EUIPO is not offering any legal advice and is discharged of any liability, including any damage caused by the service provider or by the EDR service to the SME or to third parties, during, or as a consequence of, performance of the service.

The EUIPO will not reimburse or assume any costs incurred by services provided by the SME for services provided by third parties.

The information contained in this website should not be considered advertising for legal services under the laws and rules of professional conduct of any of the EU/EEA Member States.

Upon presentation of a request and based on the information included in the form, the EUIPO will contact the SME and will offer support, either by assigning an EDR case handler or a list of the available IP pro bono providers that meet its criteria. The choice of, and contact with, the IP pro bono provider will depend exclusively on the SME’s initiative. The EUIPO free IP personalised consultation is limited to the provision of one service per SME. Once the SME has received the pro bono service, it is its sole responsibility to request and negotiate any further remunerated services directly with the pro bono provider.
