1. Introduction
Top

RCD-ONLINE provides online access to information on Community designs.

The information is taken from the internal systems used by the OHIM to process design registrations as published in the Community Designs Bulletin. Please note that for technical reasons, for designs published in the first eight publications of the Community Designs Bulletin, the views cannot be magnified.

The information in RCD-ONLINE may not necessarily reflect all the information contained in the Register. A copy of the file may be requested for further information. Please refer to our contact page for further details.

PLEASE NOTE: RCD-ONLINE should not be used to establish with certainty that there are no earlier conflicting rights in a given case. Furthermore, it should be understood that only published information is searchable. This means that the searchable information on deferred designs is minimal.

We also recommend that a design search would be performed to check for other possible prior rights.

Initial searches are performed from either the basic or the advanced search screen. Further searches may be performed on the basis of the results of a prior search using the refine search option. Twenty results are displayed per screen, with a summary given for each case.

Changing language, i.e. clicking on the ES/DE/EN/FR/IT buttons on the top-right of the page, will not normally change the results, with the exception of the criterion indication of product, where language-dependent stemming is applied. It is therefore not recommended to change the navigation language while modifying or refining a search.

Combining multiple search criteria automatically uses ‘AND’, as the mathematical ‘logical operator’, between the various criteria, i.e. the results will only include cases where all conditions are met.

Multiple selections within one search criterion (e.g. searching for several countries of priority) usually use the logical operator ‘OR’ between the values.

Searches are not case-sensitive, i.e. no difference is made between lower and upper case characters.

"Last updated on dd/mm/yyyy" displayed at the bottom of the initial search screen indicates the last date upon which changes have been made. RCD-ONLINE is usually updated with the same frequency as the RCD Bulletin.

The main differences between the basic and advanced search functions are as follows:

2. Basic Search Overview
Top

The basic search screen offers the following input options:

  • Design number
  • Owner name or ID
  • Filing date
  • Locarno classification - limited to one class, with one sub-class (optional)
  • Indication of the product

 


3. Search by Design Number
Top

This field is available in the basic search and in the advanced search mode. The design number must consist only of numbers. This search field overrides all other criteria, i.e. other criteria are ignored if the design number is entered.

Leading zeros do not need to be introduced and will be ignored.

A design number is divided into two parts: Root Number (9 digits) and Sequence Number (4 digits). The root number is mandatory. If no sequence number is present, all results with the respective root number will be returned.

For example:

  • 243480-1 is considered as 000243480-0001
  • 243480 returns results for 000243480-0001, 000243480-0002, etc.


4. Search by Owner
Top

This field is available in the basic search mode and in the advanced search mode. This criterion can be used to limit searches to designs belonging to a specific owner, either by entering the whole or a part of their name, or by entering an ID No issued by the OHIM.

In the basic search mode, the following options are available for further defining the search: 'Contains', 'Is', 'Begins with', and 'Ends with'.

In the advanced search mode, wildcards ("*" = any string of characters) and jokers ("?" = any single character) may be used.


5. Search by Filing Date

This field is available in the basic search and in the advanced search.

From and/or to dd/mm/yyyy

  • No dates specified: all designs searched
  • From date specified: all designs filed from that date to present day
  • To date specified: all designs filed up to and including that date
  • From and to dates specified: all designs filed between those two dates inclusive
The earliest date for this field is 1 April 2003, when the processing of applications started.


6. Search by Locarno Classification

In the basic search mode, one class and one optional subclass are permitted

In the advanced search mode, multiple classes and optional subclasses may be entered, along with the option of applying the logical operators AND and OR between the classes/subclasses.

For products that may appear in various classes (e.g. graphical symbols, logotypes, labels, packaging, icons, get-ups), it is recommended to search across all different possible classes.

The edition of the Locarno classification is not specified in the OHIM database. Due to this, users should consider the following facts with regards to different editions of this classification and the EuroLocarno, respectively:
  • the Locarno Subclasses 06-02 and 14-04 are available for RCDs with a filing date on or after 01.01.2004;
  • the Locarno Class (“LOC Cl.”) 99-00 was available for RCDs with a filing date prior to the 01.01.2009;
  • the LOC Cl.32-00 is available for RCDs with a filing date on or after 01.01.2009;
  • beds and similar products indicated in RCDs with a filing date prior to 01.01.2004 were classified in the LOC Cl. 06-01, and in RCDs with a filing date on or after that date are classified in the LOC Cl. 06-02;
  • screen displays and icons and similar products indicated in RCDs with a filing date prior to 01.01.2004 were classified in the LOC Cl. 14-02, and in RCDs with a filing date on or after that date are classified in the LOC Cl. 14-04;
  • products like get-up, graphic designs, graphic symbols, logos, ornamentation and surface patterns indicated in RCDs with a filing date prior to 01.01.2009 were classified in the LOC Cl. 99-00, and in RCDs with a filing date on or after that date have been classified in the LOC Cl. 32-00;
  • in RCDs with a filing date prior to the 01.01.2009, the following products were classified in the LOC Cl. 99-00: Coffin linings, Coffins, Crematory urns, Collection boxes for religious purposes, Collection bags for religious purposes, Holy-water stoups, Incense burners and Ingots;
  • in RCDs with a filing date on or after the 01.01.2009, “Coffin linings”, “Coffins” and “Crematory urns” are classified in the LOC Cl. 6-04, “Collection boxes for religious purposes” in the LOC Cl. 9-03, “Collection bags for religious purposes” in the LOC Cl. 9-05, “Holy-water stoups” and “Incense burners” in the LOC Cl. 11-02 and “Ingots” in the LOC Cl. 11-99.

7. Search by Indication of the Product

This field is available in the basic search mode and in the advanced search mode.

Searches are not case-sensitive. Each word is considered individually when multiple words are entered, and stemming is applied, i.e. search results will include words that share the same stem, e.g. "house" will also find "houses", "housed", and "housing".

The following search options are possible under the basic search mode:

IS <text input> - produces results with the same words as specified in the text box (<text input>)
CONTAINS <text input> - produces results with words that contain any portion of what is specified in the text box (<text input>)
BEGINS WITH <text input> - produces results containing words that begin with what is specified in the text box (<text input>)
ENDS WITH <text input> - produces results containing words that end with what is specified in the text box (<text input>)

Under the advanced search mode, 'Indication of the product' operates differently, dispensing with the 'IS', 'CONTAINS', 'BEGINS WITH', and 'ENDS WITH' operators, and allowing mathematical logical operators (Boolean expressions), for example: "table NOT (dining OR coffee)". Wildcards ("*" = any string of characters) and jokers ("?" = any single character) may also be used.

 

8. Additional Criteria for Advanced Search

In addition to the basic search mode input options , the advanced search screen offers:

  • Representative name or ID
  • Designer name or ID
  • Priority date
  • Publication date
  • Expiry date
  • Country of owner
  • Country of priority
  • Vienna classification
  • Verbal element
  • Status

In addition, under advanced search mode, the following fields function differently in that they allow for the use of wildcards and/or mathematical logical operators :

  • Owner
  • Locarno class-subclass
  • Indication of the product

9. Search by Representative
Top

This field is available only in the advanced search mode.

This criterion can be used to limit searches to designs corresponding to a specific representative, either by entering the whole or a part of that representative’s name, or by entering a Representative ID No issued by the OHIM.

Wildcards ("*" = any string of characters) and jokers ("?" = any single character) may also be used.

A link to CTM-AGENT is located below the 'Search by Representative' field. Clicking on the CTM-AGENT link will open a new window giving access to the agent search service . This service provides the contact details of OHIM professional representatives and associations of representatives entered in the OHIM's database.

 


10. Search by Designer
Top

This field is available only in the advanced search mode.

This criterion can be used to limit searches to designs of a specific designer, either by entering the whole or a part of their name.

Wildcards ("*" = any string of characters) and jokers (" ? " = any single character) may also be used.


11. Search by Priority Date
Top

This field is available only in the advanced search mode.

From and/or to, dd/mm/yyyy

  • No dates specified: all designs searched
  • From date specified all designs from that date to present day
  • To date specified: all designs up to and including that date
  • From and to dates specified: all designs between the two dates inclusive
The earliest date for this field is 1 October 2002 , six months prior to the earliest RCD filing date.

 


12. Search by Publication Date
Top

This field is available only in the advanced search mode.

From and/or to, dd/mm/yyyy

  • No dates specified: all designs searched
  • From date specified all designs from that date to present day
  • To date specified: all designs up to and including that date
  • From and to dates specified: all designs between the two dates inclusive
The earliest date for this field is 1 April 2003, when the processing of applications started.



13. Search by Expiry Date

This field is available only in the advanced search mode.

From and/or to, dd/mm/yyyy

  • No dates specified: all designs searched
  • From date specified: all designs expiring from that date to present day
  • To date specified: all designs expiring up to and including that date
  • From and to dates specified: all designs expiring between those two dates inclusive
The earliest date for this field is 1 April 2008, when the processing of renewal applications started.

 


14. Search by Country of Owner
Top

This field is available only in the advanced search mode.

This field allows users to limit their searches to designs with owners from one or more specified countries.

The countries are selected by clicking on the image of the globe and, one by one, selecting them from the left hand box and clicking on the "add" button, then clicking on "select" once complete. Multiple selections implicitly apply the logical operator ‘OR’, e.g. all results from Spain OR Poland OR France are included, comprising the results from any combination of these, i.e. Spain AND France or any other combination of the three.

 


15. Search by Country of Priority

This field is available only in the advanced search mode.

This field functions in the same way as the Country of Owner field, allowing for the user to limit the search to designs with priority rights from one or more specified countries.

 


16. Search by Vienna Classification
Top

This field is available only in the advanced search mode.

Format aa.bb.cc

This field functions in the same way as the Country of Owner field, with the addition of the choice of 'AND' or 'OR' as logical operator.

By clicking on the Vienna Classification link, you can access further information on the purpose of and the logic behind the Vienna classification.

The Vienna Classification is used only in the context of the following Locarno classes:

  • 01.01 Food stuffs
  • 05.05 Textiles
  • 09.01 Bottles
  • 09.03 Packaging for foodstuffs
  • 19.04 Books
  • 19.08 Other printed material
  • 99.00 Miscellaneous for RCDs with a filing date prior to 01.01.2009; and
  • 32.00 Graphic symbols and logos, surface patterns, ornamentation for RCDs with a filing date on or after 01.01.2009

 


17. Search by Verbal Element
Top

This field is available only in the advanced search mode.

This field will usually reflect any readable 'word' element contained within at least one of the views of the design, such as letters, words, numerals, keyboard signs, space, or punctuation, appearing in the representation of a design independently of any graphical elaboration or special fonts or styles.

Translations, similarity of meaning, phonetic similarities, figurative equivalence, mental connotations, etc. are NOT taken into account.

 


18. Search by Status
Top

This field is available only in the advanced search mode.

A drop-down menu enables searches to be limited to certain statuses of designs which are in a particular status. Please consult the glossary for more information.

 


19. Sorting Criteria

Top

Sorting may be done by:

  • Design number
  • Name of owner
  • Filing date
  • Date of publication in A.1.
  • Locarno classification
  • Indication of the product
  • Word element (advanced search mode only)
  • Status

Please note that sorting by 'Verbal' element is available, but only when in the advanced search mode.

All sorting criteria can be either in ascending or descending order.

In the basic search mode, the default sorting criterion is ascending design number. For advanced search mode, there is no default sorting criterion.

 


20. List of Results
Top

Number of results: 20 per page

The user will only ever be able to browse the first 1,000 results, according to the sorting criteria. However, no limits are applied when executing further refined searches, which are always performed against the full set of previous results.

The list of results shows the following fields for fully published designs:

  • RCD number
  • First view
  • Name of owner
  • Filing date
  • Locarno class and subclass
  • Word element
  • Indication of the product
  • Status

For deferred designs, the fields displayed are as follows:

  • RCD number
  • Name of owner
  • Filing date
  • Status

The user can then find out more information about a design by clicking on the design number. Clicking on the view will display the image at published size.

The "Search Unsuccessful" page indicates that the search was correctly executed according to the parameters entered, but that no results were found.

 


21. Save Results to MyPage
Top

This function only works for registered users who are already logged on to MyPage.

By clicking on "Save Results to MyPage", the user can keep a personal record of searches performed for later retrieval.

 


22. Refine Search
Top

This option enables the user to narrow down the search results.

A summary table of the previous criteria applied is displayed at the top of the "refine search" page.

A refined search may be further refined if desired, each time effectively combining the requested criteria with all previous criteria.

Up to 1,000 results are browseable, while further refined searches are performed against the full set of previous results.

 


23. Design Detailed Page
Top

Overview (default view): enables the user to view a complete listing of the design details, as published, on one page.

The design number, the result number, and the total number of results are displayed at the top of the page.

Sections can be expanded by clicking on the "+" sign wherever it appears.

The design details are displayed in the following order:

    • Design
    • Representation
    • Indication of the product
    • Owner
    • Representative
    • Designer
    • Exhibition Priority
    • Priority
    • Publication
    • Renewals

Each section is defined as follows.

23.1 Design

This section gives the following details on the design:

  • Filing, registration, and publication dates
  • Locarno classification
  • Verbal element
  • Vienna classification
  • Status (see glossary for more information)
  • Language of filing , chosen by the owner or representative among the official languages of the European Union
  • Indication of the second language chosen by the owner or representative among the five official languages of the Office (Spanish, German, English, French, or Italian)

23.2 Representation

The design may be represented by up to seven views. All published views are displayed; clicking on the view will display the image at published size.

23.3 Indication of the product

The criterion "indication of the product" is multilingual, and can be visualised in any EU language by clicking on the "+" and selecting the language desired.

By default, the user will view this field in the current navigation language (i.e. ES, DE, EN, FR, or IT).

23.4 Owner

As there is currently no recordal module, this field will show only information regarding the original applicant.

23.5 Representative

Telephone and fax numbers appear with the international code 00 (from Spain ) plus the country code.

23.6 Designer

The name of the designer or team of designers and the ID No are given for each designer.

23.7 Exhibition Priority

Information regarding the exhibition name, location, and date is provided.

23.8 Priority

The result fields (country, date, and number of application) are repeated for all related priority entries.

23.9 Publication

All publication entries relating to the particular design are presented. The online bulletin can be accessed by clicking on the Community Designs Bulletin reference. Publications appearing in all the different parts of the Community Designs Bulletin may be accessed.

23.10 Renewals

Information about the Expiry Date, Status of Renewal, Renewal Instance (i.e. how many times the RCD has been renewed, which can be up to maximum of five) is provided. In addition to that basic information, a full History of Statuses is displayed with the corresponding status date.

24. Download Design Details
Top

This allows the downloading of design details in "SGML" or "CSV" formats (readable by Microsoft Excel and similar applications). All the information on the relevant design may be downloaded to a single file on a PC.

 


25. Printer-Friendly Layout
Top

By clicking on the printer icon near the top right of the page, the current page will be displayed in a format adapted for printing on the most common paper sizes (e.g. A4, Letter) in portrait mode.

The page will automatically revert back to the normal layout for browsing, or it can be manually changed by clicking on the "Back" icon (instead of the icon for printer-friendly layout).

26. How to Use Logical Operators
Top

Boolean expressions using 'NOT', 'AND', 'OR', and brackets are recognised.

Use 'AND' to find only results containing all terms, use 'OR' to find any documents containing at least one of the terms, and use 'NOT' before a term to exclude unwanted terms.

Multiple logical operators obey the following rules of precedence: 'AND' operators take precedence over 'OR' operators - "x OR y AND z" will search for y together with z and x regardless of any occurrence of z. With bracketing, the logical operators may be combined in a different order of precedence - "(x OR y) AND z" will return occurrences of z together with either x or y.

Examples (using Vienna codes):

  • 1.1.99 = 01.01.99 (leading zeroes unnecessary)
  • 1.1.99 25.1.92 = 1.1.99 AND 25.1.92
  • 1.1.99 OR 25.1.92 AND 26.1.99 = 1.1.99 OR (25.1.92 AND 26.1.99)
  • 1.1.99 NOT 25.1.92 OR 26.1.99 AND 25.12.99 = 1.1.99 ((NOT 25.1.92) OR (26.1.99 AND 25.12.99))

In addition, the wildcards ("*") and jokers ("?") may be used in some text-based fields, examples:

  • "abc*" will search any text starting with the "abc"
  • "*abc" will search for any text ending in "abc"
  • "*abc*" will search for any text with "abc" occurring anywhere
  • "abc?e" will search for any text with that pattern, e.g. "abcae", "abcbe", etc.
